BTI: I thought I was the only one reading the qualifying clause the way
you are. After the Dave T, a tax person, weighed in, I decided I must
be wrong.

My understanding, having read the qualifying regs for the credit, is the
same as yours. I thought that "if married" was about the current status
of the applicant. I assumed a divorced party that didn't co-own with
previous spouse does qualify. However, I do not know enough about
state laws regarding community property to know how it applies here.

Interesting how the qualifying language isn't that clear.
